DLĦ and eNGOs Win Court Case against development of swimming pool in rural area

DLĦ is proud to announce a significant victory in its ongoing efforts to preserve rural landscapes and promote sustainable land use. In yet another ruling, the Court of Appeal presided over by Chief Justice Mark Chetcuti, has sided with DLĦ and other eNGOs , revoking the development permission for the construction of a swimming pool on rural land by Mark Agius, a partner of Joseph Portelli.

“This was a joint effort by a number of eNGOs concerned with our built and natural environment in Malta and Gozo in particular. The court’s sentence highlights in particular the incorrect interpretation of the facts as established by the Environment and Planning Review Tribunal (EPRT). This is not the first time that this has occurred so it should come as another wake-up call to the Tribunal to take cognizance of the facts and act accordingly.” said Patrick Calleja executive President of DLĦ.
